What the City Can Regulate under SB 946
- Health, safety, and ADA accessibility standards
- Hours of operation (as long as not overly restrictive)
- Sanitation, trash, spill prevention, and food‑handling requirements
- Permit requirements such as business license, seller’s permit, and health permits
- Restrictions in limited areas based on documented safety/welfare concerns
- Rules for vending near special events, farmers markets, and permitted concessions
- Stationary vending in residential zones (may prohibit)
What the City Cannot Regulate under SB 946
- Cannot outright ban sidewalk vending
- Cannot limit the number of vendors unless tied to objective health/safety concerns
- Cannot restrict vending to certain neighborhoods or require private business approval
- Cannot prohibit roaming vendors in residential areas
- Cannot ban vending in parks unless tied to exclusive concessions or safety impacts
- Cannot impose criminal penalties—only administrative fines are allowed
